By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services. Your continued use of the Services constitutes acceptance of any modifications to these Terms.

2. DESCRIPTION OF SERVICES

Novira AI is an AI-powered skincare application that provides personalized skincare recommendations, product suggestions, routine generation, and skin analysis. Our Services include but are not limited to:

  • AI-powered skin analysis and assessment

  • Personalized skincare product recommendations

  • Custom skincare routine generation

  • Product discovery and filtering

  • Progress tracking and goal setting

  • Subscription-based premium features

3. ELIGIBILITY AND REGISTRATION

To use our Services, you must:

  • Be at least 13 years of age

  • Have the legal capacity to enter into binding agreements

  • Provide accurate and complete registration information

  • Maintain the security of your account credentials

  • Accept responsibility for all activities under your account

4. SUBSCRIPTION TERMS

4.1 Subscription Plans

We offer subscription-based access to premium features:

  • Monthly Plan: $9.99 per month

  • Yearly Plan: $35 per year (approximately $2.92 per month)

  • 3-day free trial for new users

4.2 Billing and Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You authorize us to charge your payment method for all fees incurred during your subscription period.

4.3 Cancellation

You may cancel your subscription at any time through your device's subscription settings or by contacting customer support. Cancellation takes effect at the end of the current billing period.

4.4 Refunds

Refunds are provided in accordance with applicable laws and platform policies. We do not guarantee refunds for partially used subscription periods.

5. ACCEPTABLE USE POLICY

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations

  • Infringe upon intellectual property rights

  • Attempt to gain unauthorized access to our systems

  • Interfere with or disrupt the Services

  • Use the Services for commercial purposes without authorization

  • Share your account credentials with others

  • Upload malicious content or attempt to harm our systems

6. INTELLECTUAL PROPERTY RIGHTS

The Services and their content, features, and functionality are owned by Novira AI and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to our Services, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of providing our Services.

7. USER CONTENT AND PRIVACY

You are responsible for all content you submit to our Services. You represent and warrant that:

  • You own or have the right to use all content you submit

  • Your content does not violate any third-party rights

  • Your content is accurate and not misleading

  • Your content complies with applicable laws

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE

  • WARRANTIES OF NON-INFRINGEMENT

  • WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE

  • WARRANTIES REGARDING THE ACCURACY OF RECOMMENDATIONS OR ANALYSIS

9. MEDICAL DISCLAIMER

IMPORTANT: Our Services are for informational and educational purposes only. We are not medical professionals, and our recommendations are not medical advice. You should:

  • Consult with qualified healthcare professionals for medical concerns

  • Not rely solely on our recommendations for medical decisions

  • Discontinue use if you experience adverse reactions

  • Seek immediate medical attention for serious skin conditions

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVIRA AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, OR USE

  • PERSONAL INJURY OR PROPERTY DAMAGE

  • EMOTIONAL DISTRESS

  • DAMAGES RESULTING FROM USE OF RECOMMENDED PRODUCTS

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Novira AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Services or violation of these Terms.

12. TERMINATION

We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting customer support.

Upon termination, your right to use the Services will cease immediately, and we may delete your account and data in accordance with our Privacy Policy.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless prohibited by applicable law.

14. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date.

Your continued use of the Services after such changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue use of the Services.

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

16. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Novira AI regarding the Services and supersede all prior or contemporaneous communications and proposals.

17. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without restriction.

18. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to

  • natural disasters

  • war

  • terrorism

  • riots

  • fire

  • or government actions.

19. WAIVER

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Novira AI.
